Terms of Service

1. About the Platform

Sound To Sounds ("Platform", "we", "us") is an audio sample marketplace where creators can sell original sample packs and producers can purchase them for use in their music. These Terms of Service ("Terms") govern your access to and use of the Platform.

2. Eligibility and Accounts

• Age: You must be at least 18 years old, or have the consent of a parent or legal guardian, to use the Platform.
• Account security: You are responsible for maintaining the security of your account credentials. Notify us immediately at [email protected] if you suspect unauthorised access.
• Accurate information: You must not create an account using another person's identity or provide false information.
• One account: Each person may maintain one account. Duplicate accounts may be removed.

3. Creator Content

By uploading content to the Platform, you ("Creator") represent and warrant that:

• — You are the sole author and owner of all uploaded audio files, or you hold all necessary rights and licences.
• — Your content does not infringe any third-party intellectual property rights, including copyright, trademark, or neighbouring rights.
• — Your content does not contain samples or recordings licensed from other platforms or libraries unless you hold a redistribution licence.
• — Your content does not include hate speech, illegal material, malware, or content that violates the rights of any individual.

4. Licence Granted to the Platform

By uploading content, you grant the Platform a non-exclusive, worldwide, royalty-free licence to: store and back up your files; display product pages and preview clips; generate waveform visualisations and MP3 previews; and use screenshots and audio clips for marketing the Platform and your content. This licence does not transfer ownership and ends when you remove your content from the Platform.

5. Purchases and Payments

• Credits: Purchases on the Platform are made using credits included in a subscription plan. Credit values and plan pricing are shown on the Pricing page.
• Creator earnings: Creators receive a share of each sale as defined in the Creator Agreement. The current split is displayed in your Creator Dashboard.
• Payouts: Earnings are paid out subject to minimum threshold and payout schedule set out in the Payout Policy.
• Taxes: You are solely responsible for any taxes applicable to your income or purchases in your jurisdiction.

6. Refund Policy

Because samples are digital files that are delivered immediately upon purchase, all sales are generally final. Refunds or credit reversals may be issued only in the following cases:

• ✓ The delivered file is corrupted or technically unusable.
• ✓ You were charged for a product materially different from what was described.

Refunds are not issued for reasons such as "I changed my mind" or "it doesn't fit my project." To request a refund, contact [email protected] within 14 days of purchase.

7. Copyright and DMCA

We respect intellectual property rights and respond to valid copyright complaints. To submit a takedown notice, include the following and send to [email protected]:

• — Identification of the copyrighted work you claim has been infringed.
• — URL or description of the allegedly infringing content on our Platform.
• — Your contact information (name, address, email, phone).
• — A statement that you have a good faith belief the use is not authorised.
• — Your physical or electronic signature.

We will process valid notices promptly. Creators who receive a takedown notice may submit a counter-notice if they believe the claim is incorrect. Repeat infringers will have their accounts terminated.

8. Account Termination

We reserve the right to suspend or terminate your account, withhold pending payouts, or remove content if you: breach these Terms; upload infringing or illegal content; engage in fraudulent activity; or attempt to abuse or circumvent our systems. You may close your account at any time by contacting support.

9. Limitation of Liability

To the fullest extent permitted by law, the Platform shall not be liable for: any copyright dispute arising from Creator-uploaded content; loss of revenue, profit, or data; indirect, incidental, or consequential damages of any kind; or claims by third parties arising from your use of the Platform. The Platform's total aggregate liability shall not exceed the total amount you paid to us in the 12 months preceding the claim.

10. Changes to These Terms

We may update these Terms from time to time. We will notify registered users by email or via a notice in the Platform. Continued use after the effective date constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the Republic of Latvia and the European Union. Disputes shall be resolved in the courts of Latvia.
